Being involved in a car accident in New York City is a stressful and often frightening experience. The steps you take in the hours and days immediately following a crash can significantly impact your ability to recover compensation.
Step 1: Check for Injuries and Call 911
Your safety comes first. Check yourself and passengers for injuries. Call 911 immediately – even if injuries seem minor. A police report creates an official record of the accident that will be crucial to your claim.
Step 2: Document the Scene
If it is safe to do so, photograph the vehicles, road conditions, traffic signals, skid marks, and any visible injuries. Get the names and contact information of all witnesses.
Step 3: Exchange Information
Exchange name, address, driver’s license number, license plate, and insurance information with all other drivers. Do NOT admit fault or apologize – even a casual “I’m sorry” can be used against you.
Step 4: Seek Medical Attention Immediately
See a doctor as soon as possible – ideally the same day. Many serious injuries (whiplash, spinal injuries, concussions) don’t show symptoms immediately. A medical record created close to the accident date is powerful evidence in your case.
Step 5: Report the Accident
In New York, you must file a DMV MV-104 accident report within 10 days if there is personal injury or property damage over $1,000.
Step 6: Do NOT Talk to the Other Driver’s Insurance Company
Insurance adjusters are trained to minimize your claim. Do not give a recorded statement to any insurance company before consulting with an attorney.
Step 7: Contact a Personal Injury Attorney
